GO8542: Prescribed Body Corporate (PBC) Strategic Projects

Overview

The Prescribed Bodies Corporate (PBC) Strategic Projects grant opportunity provides funding to PBCs and other eligible organisations to pursue strategic and economic opportunities that support PBCs, Traditional Owner Group Entities (TOGEs) and Traditional Owner Corporations (TOCs) to have capacity to maximise social, cultural and economic outcomes for their Native Title-holding groups and improve land-use decision-making.

The objectives of the PBC Strategic Projects grant opportunity are to support PBCs, TOGEs and TOCs to: take advantage of strategic and economic opportunities support effective Native Title agreement-making and partnerships with governments and industry.

The outcomes of the PBC Strategic Projects grant opportunity are for PBCs, TOGES and TOCs to: have capacity to maximise the social, cultural and economic aspirations of their Native Title holding group promote greater efficiency in land use decision-making.

Eligibility Criteria

Applicants must be a PBC determined by the Federal Court of Australia to hold Native Title rights and interests in trust, or an agent prescribed body corporate; a Traditional Owner Group Entity incorporated to represent Traditional Owner Groups in Victoria under the Traditional Owner Settlement Act 2010 (Victoria); a Traditional Owner Corporation established to represent traditional owners under an alternative Native Title settlement agreement; or a third party with written authorisation from the PBCs, TOGEs or TOCs intended to benefit.

Eligible third parties may include subsidiary entities, Native Title Representative Bodies or Service Providers, relevant peak bodies, and private consultancies.

Applicants must have an ABN, unless an exemption is granted at the decision-maker's sole discretion; be registered for GST; hold an account with an Australian financial institution; and be an Aboriginal and/or Torres Strait Islander corporation registered under the CATSI Act, an Australian company, incorporated association, incorporated cooperative, organisation established through specific Commonwealth or state/territory legislation including public benevolent institutions, churches and universities, Australian state or territory government body, Australian local government body, incorporated trustee for a trust, or partnership.

Applicants must contact their local NIAA Regional Office to discuss the proposal before applying.

Proposed activities must align with at least one grant objective and be delivered in Australia unless NIAA grants an overseas exemption.

Funding may support activities aligned with the grant objectives, including developing and implementing strategic, economic development and business plans; developing land-use plans, country planning and cultural mapping tools; establishing corporate structures, subsidiary enterprises, joint ventures and industry partnerships; mapping community skills and training needs; communication and engagement with PBC members, Native Title holders and stakeholders; co-design between PBC groups for joint projects; planning for negotiation or implementation of Native Title and Traditional Owner agreements; accessing technical or legal expertise; and engaging staff for one-off strategic and economic activities, but not ongoing operational roles. Minor capital expenditure of up to 100000 GST exclusive per grant may be used to purchase or upgrade equipment and/or office space critical to delivering the grant activity. Grant funds may only be spent on eligible activities and expenditure defined in the executed grant agreement.
