GO4966: Performance of representative body functions

Overview

The Native Title Act 1993 (the Act) provides for the Australian Government, through the National Indigenous Australians Agency, to fund entities to perform the ‘representative body’ functions listed in section 203B of the Act.

These functions include assisting native title claimants and holders to progress native title claims, negotiate native title agreements and resolve native title disputes.

This grant opportunity will continue the delivery of these services by funding selected entities to perform these functions.

Eligibility Criteria

To be eligible you must be invited by the Agency to apply (the Agency will invite all NTRBs recognised by the Minister under section 203AD of the Native Title Act and all NTSPs currently funded by the Agency).

Applicants must have an Australian Business Number (ABN) (exemptions may apply), where relevant be registered for GST, if an individual be a permanent resident of Australia, and have an account with an Australian financial institution.

Applicants must have rectified any issues of previous non-compliance with existing Commonwealth agreements or be in the process of rectifying them to the satisfaction of the Commonwealth, and be financially viable (the Agency may undertake enquiries regarding financial viability).

Eligible uses: delivery of representative body functions as set out in section 203B of the Native Title Act, including facilitation and assistance (assisting groups to bring native title claims and negotiate agreements including ILUAs), certification, dispute resolution (mediation), notification of proposed future acts, agreement‑making (being a party to ILUAs), internal review processes, and other functions (informing and consulting on native title matters). Eligible expenditure items explicitly include capital costs, wages, and other costs incurred in performing representative body functions. Activities must be delivered in Australia (unless an exemption is granted) and in alignment with relevant COVID-19 public health advice; applicants are required to develop a COVID-19 Risk Management Plan on request. Proposals should consider cultural and linguistic needs, disability access, and differing barriers experienced by subsets of target communities. Ineligible uses (explicit): payment of fines or loans, purchase of gifts, personal debts, sitting fees, costs incurred preparing grant applications (unless specifically agreed), activities for which other government bodies have primary responsibility, and expenses for which other government bodies have primary responsibility unless specifically agreed in writing.
