Stamp duty waivers on eligible electric vehicles purchased in NSW

Overview

A stamp duty exemption on eligible new and used light battery electric vehicles (BEVs) and hydrogen fuel cell vehicles (FCEVs) registered in NSW.

Eligible vehicles with a dutiable value up to and including $78,000 were exempt from stamp duty for registrations from 1 September 2021 until the exemption ended on 31 December 2023.

Eligibility Criteria

Eligible vehicles: new or used light BEVs and FCEVs (gross vehicle mass 4.5 tonnes or less, includes motorcycles) with a dutiable value up to and including $78,000.

The vehicle must be registered on or after 1 September 2021.

Purchases or at least a deposit must have been made on or before 31 December 2023 to be eligible.

Any NSW resident or business registering or purchasing these vehicles between 1 September 2021 and 31 December 2023 for personal or business use were eligible for the exemption.

The dutiable value is the total amount paid (including GST) for the vehicle, including delivery costs, accessories and options and other dealer charges or fees; it does not include NSW Government charges administered by Transport for NSW (registration fees, vehicle weight tax), the cost of CTP insurance or premium for extended warranty insurance.

Eligible vehicle categories explicitly include passenger vehicles, sports utility vehicles, light trucks/light commercial vehicles and motorcycles.

Evidence required when applying for a refund or exemption:

  • current and valid NSW Driver Licence (for individual or business contact person matching registration details)
  • Certificate of Registration (showing registration number, registration history, registered owner, vehicle use, VIN, duty paid amount)
  • contract to purchase indicating sale price and deposit payment (if applicable)
  • deposit receipt (where applicable) dated on or before 31 December 2023
  • tax invoice if interstate purchase or purchase from Tesla, Polestar and Vyro

Application timing: for registrations/transfers between 1 September 2021 and 14 August 2022, a stamp duty refund could be applied for from 1 November 2021 via the NSW Government online application portal.

Registrations from 15 August 2022 to 31 December 2023 had the exemption applied automatically.

From 1 January 2024, stamp duty is payable but can be claimed back (only for eligible EVs purchased or with a deposit paid by 31 December 2023) via the online portal.

Refund processing: Revenue NSW will review a complete application within 15 business days and, if granted, transfer the refund to the nominated bank account within 5 business days of notification of successful application.
